A. General Terms and Conditions

§ 1 Scope of Application

  1. These General Terms and Conditions ("GTC") apply to all business relationships between:

represented by the Managing Director Leon Groß (hereinafter referred to as "DIVERSITY" or "we"),

and its customers (hereinafter referred to as "Customer").

  1. Customers may be consumers or entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

An entrepreneur is a natural or legal person or a partnership with legal capacity acting in the exercise of its trade, business, or profession.

  1. We currently deliver to customers within Germany.

  2. Our products are intended for personal use only and not for resale. We reserve the right to limit quantities per customer, household, or order and to refuse or cancel orders that appear to be placed for commercial resale purposes.

§ 2 Conclusion of Contract

  1. The presentation of products in our online store does not constitute a legally binding offer but an invitation to place an order.

  2. After placing an order, the Customer receives an automatic order confirmation by email. This confirmation merely documents receipt of the order and does not constitute acceptance of the offer.

  3. A contract is concluded when we expressly accept the order by email or dispatch the ordered goods.

  4. If payment is made through PayPal, Apple Pay, Google Pay, or credit card, the contract is concluded at the latest upon execution of the payment transaction.

§ 3 Prices and Payment

  1. All prices displayed in the online shop are final prices.

  2. As a small business pursuant to Section 19(1) German VAT Act (UStG), VAT is not separately shown.

  3. Available payment methods include:

  • PayPal

  • Credit Card

  • Apple Pay

  • Google Pay

  1. Payment is due immediately upon conclusion of the contract.

§ 4 Shipping Costs

Shipping costs are displayed separately during checkout and before the Customer submits a binding order.

§ 5 Delivery

  1. Delivery is made to the address provided by the Customer during checkout.

  2. Partial deliveries may occur where reasonable and necessary. Any additional shipping costs resulting from partial deliveries shall be borne by DIVERSITY.

  3. Delivery times stated in the shop are estimates and not guaranteed delivery dates unless expressly agreed otherwise.

§ 6 Retention of Title

Goods remain our property until full payment has been received.

§ 7 Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

Detailed information regarding the right of withdrawal, including a model withdrawal form, can be found in our separate Cancellation Policy.

§ 8 Warranty and Liability

The statutory warranty rights shall apply.

Liability shall be governed by the applicable statutory provisions.

§ 9 Data Protection

The processing of personal data is carried out exclusively in accordance with applicable data protection laws and our Privacy Policy.

§ 10 Applicable Law and Jurisdiction

  1. The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. For merchants, legal entities under public law, and special funds under public law, the place of jurisdiction shall be Eisenberg, Germany.

  3. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Severability Clause

Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

§ 12 Contract Language

Contracts may be concluded in German or English.
